JUDGE: Thank you, that is enough! I have heard enough! I am court ordering AllState to pay (my full name) the amount of $15,000.00 and this ruling cannot be appealed and with prejudice. I expect you to pay her (me) within 7 to 10 business days! CASE CLOSED (Slamming Gavel multiple times and so hard that I thought he was going to break the gavel)!

Anyway, he then told BOTH of us (The Cop and I) that he had to “phone my Agent down there” tomorrow because she’s not in the office today (which was correct, because she told me she had a dentist appointment which she wasn’t looking forward to) and then he said “I will get back with you in a few days.”

12 business days later, I returned to the court, and went to the Judge’s secretary to inform her that I have not received the refund or the $15,000.00 from AllState. She relayed it to the Judge who was in his chambers and he came out and told me to “sit here, I will get on the SOB’s a$$e$ right now.”

AGENT: Failure to update new address. I told the Corporate that YOU moved on xx/xx and notified me in less than 24 hours which I updated the system.

After being on hold for 57 minutes, she then informed me this:

I think Georgia requires you to register within 10 days, and your driver’s license too - the sooner the better. Call me back if there’s any problems!”

Basically I filed suit against AllState and the Agent for breach and neglience of policy! Especially towards the Agent who made an unauthorized change on my police (reverting back to old address), refusal to provide policy coverage for this State of Georgia, and for calling the Law Enforcement Agency (provided case number and report) and cancelling my policy without any notification whatsoever which violated the State of Georgia - Georgia Code § 33-24-45.

I then found out Nationwide doesn’t provide auto coverage, I wound up going with State Farm.

After a few days passed, no response or reply from the Agent. So I phoned his office, and his secretary wasn’t the nicest person in the world, she was utterly rude and kept over-talking me. Didn’t get anywhere so I went down to the Office in person only to find out “closed” - they had very weird hours - M W TH - from 10 to 12, from 1 to 2, T (closed) F - 9 to 1 PM S 10 to 2 and Sunday - Closed.

JUDGE: But I didn’t order you to pay her $5,000.00 I ordered you to pay her $15,000.00 and now I expect this to be in our system in 2 hours! Get moving!

CORPORATE: But we can send you right now $5,000.00 and we can just call it that.

Between the Judge and the Corporate, the thing was really pissing the Judge off after he learned that agent, he submitted his retirement the end of day at the court hearing!

Judge - phoned the Corporate, and they claim that “it’s in processing Sir!” It will be out! He gave them 72 hours to get the check here in the court so she can be paid. (The check does not go to me, it goes to the Court and the court gives me their check, to make sure it’s cleared.)

Judge literally blasted the Agent, and the Corporate Lawyer (AllState) tried to state “there was just a misunderstanding” “a miscommunication between the two parties” and even tried to influence the Judge that “She’s (me) is hard of hearing so it’s possible she didn’t hear everything.”

AGENT: No, that’s the only Agent we have for that Quad-County area. He covers all 4 counties of xxx, xxx, xxx, and xxx. So I found out that up there in Georgia, they have assigned agents for that specific areas. I was going to touch bases with Agent (name) but he cannot be of assistance because you are not in his zone!

So I went down to the small Cafeteria, to wait a couple of hours and then go and see (Accounting Clerk). All of a sudden, the Fire Alarms went off, and everyone had to evacuate and go outside. This went on back to back two more times, and the 2nd time, the Judge ordered me to be in his office (Chambers) on xx:xx AM on xx/xx/xxxx. When I arrived 10 minutes early, we had to wait for half hour, because he had court ordered the AllState Agent. When he didn’t show up, he had me to go into the chambers with him and he dialed up the Corporate.

I then used his secretary’s desk to report it to the Georgia State Attorney’s Office, since they never did refund me for the overage and they made wanton delays intentionally knowing that after 30 days the judgement would be rendered null and void.

AGENT: “I have terrible news for you! You will need to find an Insurance Policy for your vehicle because that Agent CANCELED YOURS, and I had spent enough time getting on his a$$ and he kept disconnecting me so I phoned the Corporate and alerted of them to reinstate you and they cannot! Because he terminated your account on xx/xx (same day when I arrived in his office when he phoned the Cop) and you had 48 hours to contact the Corporate for any errors.”

When the Officer arrived, he was irritated with this Agent, in fact, he demanded to know why the hostility? The Agent was even MORE irritated when he pulled up my policy and IT HAD my NEW ADDRESS which was updated on Friday! I also had my old Florida License (cut in half because it’s no longer valid) and Georgia DMV had provided me a new license for the state. I also had the Georgia registration and tag paperwork.

Frustrated was I, insomuch once I returned back home I phoned my Agent and told her this weirdness. She was furious! In fact, she was going to send him an Intra-Agency email with the Corporate and MY email address so we would all have the Carbon Copy of the email correspondence.

The Judge was so pissed that he ordered AllState not just to refund me (I never got the check and it exceeded the limitations), but to pay me $15,000.00 due to the fact she (me) had went uninsured for (pauses)

Judge: If you do not hear from (name of clerk who is in accounting as she was in the office, and he introduced us), call her! (She gives me her direct line.) He expected the money to be wired to the Court as that’s what they normally do, wire the money. If I didn’t hear from her by Friday, to call her and his secretary (gives me her business card and direct line) and alert them.

In addition, I filed a formal lawsuit against that Agent and against AllState. AllState’s Legal Team tried to throw it out before the hearing “claiming frivolous lawsuit”.

She could had processed the information here in Florida, unfortunately, I didn’t know what my address was going to be until I arrived there. My (ex) husband gave me the directions but he just knew how to get there and drew it on the map and provided me the “street map” copy. Well the Georgia State Attorney FINED AllState (negligence and dragging out the judicial order) - and there, I finally got some money - $2,500.00. The State Attorney ordered them to refund the overage times 3 (my policy for the year - full coverage, premium was $833.00 a year) - rounding it off made it an even $2,500.00.

Well, as soon as she pulled up my account - I heard her “Gasp” and became silent and immediately was placed on “hold”. I was on hold for nearly an HOUR with her checking to see if I was still on the line because she had to deal with something. (The tone of her voice was of grave concern!)

AGENT: I had ordered the Corporate to send you a refund check, pro-rated. Since I have your new address written down, I’ve provided it to them. You should get a check within 10 - 14 business days in the mail.

So I went the next day (Thursday) and arrived at 10:45 but the person working there said “We only accept appointments”. So I scheduled an appointment. Next available appointment was almost 2 months!

Insurance have NO VESTED interest whatsoever with their customers - PERIOD! If you filed a claim, they will pay out as LITTLE as possible! PERIOD!

I thanked him and departed.

CORPORATE: Sir? Sir? Wait! The Agent had retired and is no longer residing in the area. He had moved to New Mexico to be with his family. He no longer is with us. The Office located at xxxxx (address, city, state, zip) is closed and all policy holders have been temporarily assigned to the out of zone Agents until a replacement can be positioned.

AGENT: Your Honor? She was uninsured on xx/xx/xxx and remained uninsured for 19 days (asks me for confirmation when State Farm began the policy?) - Yes your honor, 19 days with no insurance coverage at all, and she has the premium plus which has (reads the original policy).

ME: And?

He gave them the warning that he had signed for Contempt of Court for their Agent (full name) and he’s revoking his license to practice insurance.

Once I arrived to our new residency, I learned my (ex) husband didn’t even get the phone set up, which meant, in the morning I would have to get the phone connected. He had everything but telephone! That which I did in the morning. And later that afternoon, the phone was connected. I tried the 800 number but it was “invalid” so I phoned my Agent down in Florida and thankfully she was in the office, and she input the new address.

How?

I once sued the AllState Insurance Company and WON! However, while AllState was given the judgment to pay me $15,000.00 (reason will be disclosed below).

ME: Thank you! I guess I will have to go back to Nationwide, can an Agent up here touch bases with you down there?

I had other things to do on Monday, such as putting in the change of address and so forth. Tuesday morning, I decided to go down and meet the Agent. Once I arrived in the office; he seemed to be very annoyed! In fact, he phoned the Law Enforcement Agency because he suspected “fraud” and I was using “fake” identification!

ME: Correct your honor. There’s no need for a lawyer. I have my long time agent available on the video-phone (video conference phone was on and she was present).
